Are there any organisations here that are using warrants for access via Environmental Health in relation to Statutory Nuisance under section 79 (1)(a) of the Environmental Protection Act 1990? This would be used if there is repeated non access resulting in a property going out of compliance?

Through the discussions at forums I am aware that there are organisations that do use this route but unfortunately I cannot remember who the organisations were. Hopefully they will reply and let you know.

Hi Dan – I used to use that route back when I worked for Environmental Health at Solihull Council – I used to go to court to get the warrants on behalf of our Housing ALMO.

They don’t use that technique any more, but I’m sure I can dredge up some memories if there are any specifics you need an answer to?

    cheers
